Cancellation and Return Terms

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

 

GENERAL:

 

  1. When you place an order electronically through the website you are using, you are considered to have accepted the pre-notification form and the distance sales contract provided to you.

  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws in relation to the sale and delivery of the purchased product.

  3. Shipping expenses, which include the cargo fee, will be paid by the buyers.

  4. Each purchased product will be delivered to the person and/or organization at the address specified by the buyer within a legal period of 15 days, provided that this period does not exceed. If the product is not delivered within this period, buyers have the right to terminate the contract.

  5. The purchased product must be delivered complete and in compliance with the specified qualifications in the order, along with any warranty certificate, user manual, or other relevant documents, if available.

  6. In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer of this situation in writing within 3 days from the date of learning about it. The total price must be refunded to the buyer within 14 days.

 

In evening wear products, there is no option for exchanges or returns. By confirming the purchase, our customer acknowledges and accepts this condition, thereby completing the purchase.

If the purchase price of the product is not paid:

If the buyer does not pay the purchase price of the product or cancels it in the bank records, the seller's obligation to deliver the product shall cease.

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

If it is determined that the credit card used for payment by the buyer has been used unlawfully by unauthorized persons after the product has been delivered, and if the selling price of the product is not paid to the seller by the relevant bank or financial institution, the buyer must return the product within 3 days, with shipping costs to be borne by the SELLER.

If the product cannot be delivered within the specified time due to unforeseen reasons:

1.If unforeseeable force majeure events occur, and the product cannot be delivered within the specified time, the situation is communicated to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of delivery until the impediment is removed. If the Buyer cancels the order and has made the payment in cash, the amount is refunded in cash within 14 days from the cancellation. If the Buyer has made the payment by credit card and cancels the order, the product price is refunded to the bank within 14 days from the cancellation, but it may take 2-3 weeks for the bank to transfer it to the Buyer's account.

The Buyer's Obligation to Inspect the Product:

1.The Buyer shall inspect the product/service subject to the contract before taking delivery; any damaged or defective product/service, such as dents, breakages, torn packaging, etc., shall not be accepted from the courier company. The received product/service shall be considered undamaged and intact. The BUYER must take care of the product/service after delivery. If the right of withdrawal is to be exercised, the product/service should not be used. The invoice must also be returned with the product/service.

RIGHT OF WITHDRAWAL:

1.The BUYER; without assuming any legal or criminal liability and without any justification, has the right to withdraw from the contract within 14 (fourteen) days from the delivery date of the product to himself or to the person/organization at the address he/she indicated, provided that he/she informs the SELLER via the contact information below. (The right of withdrawal does not apply to Abiye End of Season Sale and discounted products)

RIGHT OF WITHDRAWAL PERIOD:

1.The 14-day withdrawal period for services begins from the date the contract is signed. The right of withdrawal cannot be exercised for service contracts where the service has started with the consumer's approval before the end of the withdrawal period.

2.The expenses arising from the exercise of the right of withdrawal are borne by the SELLER.

3.In order to exercise the right of withdrawal, written notification must be made to the SELLER by registered mail, fax, or email within 14 (fourteen) days, and the product must not have been used in accordance with the provisions of the "Products for Which the Right of Withdrawal Cannot Be Used" specified in this contract.

EXERCISE OF THE RIGHT OF WITHDRAWAL:

1.3. The invoice for the product delivered to the individual or the BUYER must be included. (If the invoice of the product to be returned is corporate, it must be returned along with the return invoice issued by the institution when returning. Order returns issued on behalf of corporations cannot be completed unless a RETURN INVOICE is issued.)

2.The return form must be submitted along with the complete and undamaged product box, packaging, and, if available, standard accessories of the product to be returned.

RETURN CONDITIONS:

  • The SELLER is obliged to refund the total price to the BUYER and return the documents that bind the BUYER within a maximum of 10 days from the date of receipt of the withdrawal notification.

  • If there is a decrease in the value of the goods due to a reason attributable to the BUYER or if it becomes impossible to return the goods, the BUYER is liable to compensate for the damages suffered by the SELLER in proportion to the fault of the BUYER. However, the BUYER is not responsible for changes and deteriorations in the goods or products that occur due to their proper use within the withdrawal period.

  • If the campaign limit amount set by the SELLER is reduced due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign will be canceled.

  • To initiate the return process, the customer requesting a return must provide their invoice number via WhatsApp to our company line. Products sent for return without notification to our company will not be accepted and will be returned to the customer.

  • Accepted return items can be sent back using Ptt Kargo and Yurtiçi Kargo, with whom we have agreements for return shipments.

THERE IS NO EXCHANGE OR REFUND FOR EVENING DRESSES. THE CUSTOMER WHO CONFIRMS THE PURCHASE ACKNOWLEDGES AND ACCEPTS THIS CONDITION.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

1.Items such as evening gowns, lingerie sets, swimsuit bottoms, cosmetics, single-use products, perishable goods, or items with a possibility of expiration that have been prepared based on the buyer's request or explicitly tailored to their personal needs cannot be returned.Items that, once delivered to the buyer, cannot be returned due to health and hygiene reasons if their packaging is opened by the buyer, items that have mixed with other products and cannot be separated due to their nature, goods related to periodical publications like newspapers and magazines except for those provided within a subscription agreement, instantly delivered electronic services or non-tangible goods, as well as audio or visual recordings, books, digital content, software programs, data storage devices, computer consumables, and items whose packaging has been opened by the buyer cannot be returned, as per the Regulation. Furthermore, the right of withdrawal cannot be exercised for services that have been initiated with the consumer's approval before the withdrawal period expires.

2.Cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs, and cassettes, as well as stationery consumables (toner, cartridges, ribbons, etc.), must have unopened, untested, undamaged, and unused packaging to be eligible for return.          

THERE IS NO EXCHANGE OR REFUND FOR EVENING DRESSES. THE CUSTOMER WHO CONFIRMS THE PURCHASE ACKNOWLEDGES AND ACCEPTS THIS CONDITION.

 DEFAULT SITUATION AND LEGAL CONSEQUENCES

1.The BUYER acknowledges, declares, and undertakes that if they default on their payment transactions made with a credit card, they will pay interest and be liable to the cardholder bank within the framework of the credit card agreement between them and the bank. In this case, the relevant bank may take legal action, request the incurred expenses and attorney's fees from the BUYER, and in any case of the BUYER defaulting on their debt, the BUYER agrees to compensate for the damages and losses incurred by the SELLER due to the delayed performance of the debt.

PAYMENT AND DELIVERY

  1. You can make a payment through Bank Transfer or EFT (Electronic Funds Transfer) to any of our accounts listed under the "BANK DETAILS" section using (TL).

  2. On our website, you can make payments with various credit cards using the online single payment or online installment options. In online payments, the amount will be charged to your credit card at the end of your order.
